GUARDRAIL: WHITE — CASE OVERVIEW

Orientation and navigation only. No legal strategy, no damages calculations, no evidence assertions.


0. Purpose

This tab answers a single question:

"Given who I am and what I need to do, what should I read next?"

It gives role-based reading paths through the 12-volume binder for:

  • Lead litigation counsel
  • Associates / law clerks
  • Experts (damages, banking, harassment)
  • Mediators / settlement judges
  • Regulatory / lender-side reviewers
  • Enforcement / collections counsel

This is a navigation aid only:

  • It does not add new facts, law, math, or strategy.
  • It tells you which tabs/volumes to open, not what conclusions to reach.

1. Global Principles Before You Dive In

Before role-specific paths, a few principles apply to everyone:

  1. White → Core → Specialties
    • Start with White Vol 01 (orientation),
    • Move into the core block (05–08),
    • Then branch into enforcement (09–11) or satellites (12) as needed.
  2. Evidence Before Argument
    • If you read something in Purple (strategy) or Yellow (doctrine), you should be able to see the evidence in White/Grey/Red-OATH and see the numbers in Blue/Red/Brown/Green.
  3. Executive Tabs First
    • Within any volume, start with A000 (Executive Overview) and any control/section index tabs before opening detailed schedules or chain memos.
  4. Don't Use This as a Substitute for Judgment
    • These paths are suggested defaults for getting oriented fast.
    • You are always free to skip around based on your task and time.

2. Lead Litigation Counsel (New to the File)

2.1 First 60–90 Minutes — High-Level Orientation

Step 1 — Binder Front Door (White-Overview 01)

  • Read:
    • White-Overview 01 — A000 (Case at a Glance / Binder Executive Overview)
    • White-Overview 01 — A001 (The Story)
  • Goal: Get a clean mental model of the narrative and the binder's structure.

Step 2 — Visual & Tabular Maps (White-Overview 01)

  • Scan:
    • White-Overview 01 — B001 (Visual Architecture Map)
    • White-Overview 01 — B002 (Volume Quick Reference)
  • Goal: See all 12 volumes at once; understand which colors do what.

2.2 Next 2–3 Hours — Core Case Spine

Step 3 — Damages Engines (Blue & Red)

  • Read:
    • Blue 05 — A000 (G21 Base Damages Executive Overview)
    • Red 06 — A000 (Freeman Opportunity Executive Overview)
  • Goal: Understand the two main economic engines:
    • What happened at G21,
    • What was blocked at Freeman,
    • How those pieces fit together.

Step 4 — Evidence System of Record (White 07)

  • Scan:
    • White 07 — A000 (Evidence Repository Executive Overview)
    • White 07 — Tab 001 (Master Timeline — Facts-Only)
  • Goal: See where all exhibits and WT tabs live, and how they're organized.

Step 5 — Framework & Integration (Purple 08)

  • Read:
    • Purple 08 — Binder Control / Section Index tabs
    • Selected A-series chain memos (as referenced in White A000 / B002)
  • Goal: See how the case is currently framed and integrated across volumes (without taking Purple's posture as gospel).

2.3 Enforcement & Exposure Context (Same Day or Next)

Step 6 — Recovery Capacity (Green 09)

  • Read:
    • Green 09 — A000 (Asset Landscape & Enforcement Overview)
    • Green 09 — B001 (Block 2512 Equity Analysis)
    • Green 09 — D001 (Recovery Band Calculation)
  • Goal: Confirm there is real enforcement capacity behind any judgment.

Step 7 — Administrative & Pattern Tracks (Red-OATH / Grey)

  • Scan:
    • Red-OATH 10 — A000 (OATH Harassment Executive Overview)
    • Grey 11 — A000 (Bank Fraud Pattern Evidence Overview)
  • Goal: Understand the HPD/OATH harassment lane and the lender/pattern evidence lane at a high level.

3. Associates / Law Clerks

3.1 Assignment: Drafting a Motion or Brief

Step 1 — Clarify the Motion Type

  • Ask: Is this about liability, damages, harassment, enforcement, or malpractice?

Step 2 — Go to the Relevant Volume A000

Examples:

  • Liability focusing on building conditions →
    • White 07 — A000 + Master Timeline,
    • Red-OATH 10 — A000.
  • G21 damages briefing →
    • Blue 05 — A000, then the relevant damages category tabs.
  • Freeman opportunity briefing →
    • Red 06 — A000, plus main framework tabs.
  • Enforcement/LTV issues →
    • Green 09 — A000, B001, D001.
  • Malpractice strategy support →
    • Orange 12 — A000 (once QA-complete).

Step 3 — Pull Facts from Evidentiary Homes

  • Always start with:
    • White 07 (WT-series, exhibits, transcripts)
    • Red-OATH 10 (for administrative harassment facts)
    • Grey 11 (for loan/covenant vs condition facts)
  • Use: White C001's grid as a sanity check for proper placement.

Step 4 — Pull Law and Doctrine

  • See:
    • Yellow 02 (enterprise & Method-2 doctrine)
    • Brown 04 (rent law & rent restitution frameworks)
    • Green 09 — C001 (lien priority rules)

Step 5 — Pull Numbers from Damages/Math Volumes

  • See:
    • Blue 05 (G21 base damages)
    • Red 06 (Freeman opportunity)
    • Brown 04 (rent restitution calculations)
    • Pink 03 (punitive multipliers)
    • Green 09 — D001 (recovery bands)

Rule of thumb: If your draft includes a number, it should be visible in one of these math volumes.

3.2 Assignment: Preparing a Fact or Exhibit Packet

  • Start: White 07 — A000 + Tab 001 (Master Timeline)
  • Filter: Identify the relevant time window and event cluster.
  • Collect: WT tabs and exhibits for that cluster.
  • Cross-check: Any OATH/HPD references in Red-OATH 10, any loan/covenant references in Grey 11.

4. Experts

4.1 Damages Expert (G21 / Freeman / Rent)

Step 1 — Orientation

  • Read:
    • White-Overview 01 — A000 / A001
    • Blue 05 — A000
    • Red 06 — A000

Step 2 — G21 Base Damages

  • See:
    • Blue 05 — all relevant damages category tabs (property, business, alternative housing, legal/admin, etc.)
    • White 07 — exhibits and WT-tabs referenced in Blue.

Step 3 — Freeman Opportunity

  • See:
    • Red 06 — framework tabs (opportunity modeling, launch prevention)
    • White 07 — supporting evidence for Freeman and F1 chains.

Step 4 — Rent Restitution

  • Refer to:
    • Brown 04 — rent frameworks and any built schedules (where present).

Step 5 — Punitive / Multipliers (If Needed)

  • See:
    • Yellow 02 — Method-2 doctrine
    • Pink 03 — multiplier tools and ratios

Key: Experts should not need to hunt for facts; White 07 and the damages volumes should give them well-organized inputs.


4.2 Banking / Covenant / Lender-Conduct Expert

Step 1 — Overview

  • Read:
    • White-Overview 01 — A000 / B001 / B002
    • Grey 11 — A000 (Bank Fraud Pattern Overview)

Step 2 — Evidence

  • See:
    • Grey 11 — loan universe, covenant vs condition tables
    • Green 09 — B001/B002 — ACRIS extracts and asset-side facts
    • White 07 — any referenced building-condition WT tabs

Step 3 — Context

  • Refer to:
    • Red-OATH 10 — A000 (harassment / HPD/OATH posture)
    • Purple 08 (selected pattern-relevant chain memos, as identified by lead counsel)

4.3 Harassment / Housing Conditions Expert

Step 1 — Overview

  • Read:
    • Red-OATH 10 — A000
    • White 07 — Master Timeline segments related to inspections and conditions

Step 2 — Evidence

  • See:
    • OATH docket, orders, inspection reports (Red-OATH)
    • Tenant statements, photos, and videos (White 07)

Step 3 — Optional Context

  • Refer to:
    • Blue 05 — sections where physical conditions tie into damages
    • Purple 08 — strategic framing of harassment (as curated by counsel)

5. Mediators / Settlement Judges

For mediation or settlement conferences, time is often short. The goal is to understand stakes, posture, and enforceability, not every piece of evidence.

  1. White-Overview 01 — A000 and A001
    • Get the case at a glance and story overview.
  2. White-Overview 01 — B001 and B002
    • See the full architecture and what each volume does.
  3. Blue 05 / Red 06 — A000 tabs
    • Understand the two core damages engines (G21, Freeman).
  4. Green 09 — A000 and D001
    • See the asset and recovery bands; verify there is a real collection path.
  5. Purple 08 — Selected high-level chain memos
    • As curated by counsel, to see how each side is framing risk and resolution.
  6. White 07 — Specific WT tabs
    • Only where necessary to clarify key disputes or credibility issues.

Tip: Ask counsel to prepare a short reading packet that cites exact tabs and page ranges. This reduces time in the binder and focuses your review.


6. Regulatory / Lender-Side Reviewers

For regulators, AG offices, or lender counsel looking at pattern and exposure rather than purely civil damages:

  1. White-Overview 01 — A000 / B001 / B002
    • High-level understanding of the structure and players.
  2. White 07 — Targeted WT tabs
    • Especially those documenting long-term conditions, communications, and inspection records.
  3. Grey 11 — A000 + core pattern tabs
    • Loan universe, covenant vs condition patterns.
  4. Red-OATH 10 — A000 and key timeline tabs
    • Harassment posture, HPD/OATH remedies, and compliance issues.
  5. Green 09 — A000/B001
    • Confirmation of asset structure and liens (for lender counsel).

Important: Any excerpts from Purple 08 should be curated by lead counsel to avoid mixing orientation with advocacy.


7. Enforcement / Collections Counsel

7.1 Primary Path

  1. White-Overview 01 — B001/B002
    • Quick architecture and volume map.
  2. Green 09 — A000/B001/B002/D001
    • Asset landscape, Block 2512 equity, receivables, recovery bands.
  3. White 07 — WT tabs supporting Block 2512, receivables, and any asset-related facts.
  4. Grey 11 — Selected tabs, if lender pattern is relevant to enforcement strategy.
  5. Purple 08 — H-Series and any chain memos marked as enforcement-relevant.

7.2 Optional: Malpractice Track

If enforcement strategy intersects with professional malpractice (e.g., for fee recovery or coordinating with separate counsel):

  • Refer to: Orange 12 — A000 (once QA is complete) for malpractice architecture.

8. Guardrails for This Tab

To keep D001 aligned with White discipline:

  1. Pointers Only
    • D001 points to volumes and tabs.
    • It does not introduce new facts, law, math, or strategy.
  2. Role Clarity
    • The same reader may wear multiple hats; these paths are suggested defaults, not strict rules.
  3. No Hidden Advocacy
    • Phrasing avoids "you should settle" or "this is a slam dunk."
    • Any strategic framing remains in Purple 08 and related volumes.
  4. Version Awareness
    • Always defer to:
      • The version header of each volume, and
      • Any section control / change log inside that volume.
