POSTURE NOTE — Implementation & Execution Overview¶

Pink implements the calculation and execution tools for the binder system — the "HOW" that operationalizes Yellow's doctrine. This document does not establish legal theory (Yellow), compile facts (White), calculate base damages (Blue/Red/Brown), or develop negotiation strategy (Purple). Court-facing drafts present enterprise multipliers conservatively (4x-8x) in main text, reserving higher-ratio analyses (10x-20x) to Appendix/Authority materials for settlement pressure only. For pattern doctrine see Yellow B001; for multiplier framework see Yellow B002; for base damages see Blue/Red/Brown; for strategy see Purple.

I. Volume Role & Cross-Volume Position¶

I.A What Pink Is¶

Pink Volume 03 is the implementation & execution hub of the binder system.

It is where calculators, methodologies, expert templates, and evidence protocols live.

Pink answers:

"Given the facts (White), doctrine (Yellow), and base numbers (Blue/Red/Brown),

how do we actually calculate, evidence, and present the numbers?"

Pink is:

The execution engine for Method-2 enterprise multipliers (4x–8x band).
The home for dual-track punitive methodologies (operative vs escalation).
The place where expert declaration templates and evidence checklists live.
The volume that makes sure every number is traceable, reproducible, and defensible.

Pink is not:

A facts repository (that's White).
A doctrine library (that's Yellow).
A strategy playbook (that's Purple).

Pink never invents new facts, new law, or new strategy. It implements what White, Yellow, Blue/Red/Brown, and Purple already justify and choose.

II. How to Read Pink (30-Second Version)¶

How to read Pink. Start here at Pink Tab A000 (Executive Overview) to understand Pink's role in the system and how it connects to White, Yellow, Blue/Red/Brown, and Purple. IV. Pink's Relationship to Yellow, White, Blue/Red/Brown, and Purple¶

IV.A Yellow ↔︎ Pink — Doctrine vs Execution¶

Yellow is the legal brain for enterprise liability. Pink is the hands and instruments.

Yellow Tab B001 — 27-Year Pattern Doctrine
- Explains why the conduct qualifies as a pattern allowing enterprise-level treatment.
- Pink assumes B001 is satisfied; it does not re-argue pattern doctrine.
Yellow Tab B002 — Method-2 Enterprise Multipliers
- Explains how enterprise multipliers can be applied to total case value.
- Fixes the operative band at 4x–8x.
- Pink B001 takes this band and turns it into actual schedules over T.
Yellow Tab C001 — Legal Precedents Compendium
- Houses the case law and ratio research (including 10x–20x).
- Pink B002's tiers (O1–O3, E1–E3) point into C001 for authority; Pink itself does not quote cases.

Key rule:

If it looks like doctrine or cites lots of cases, it belongs in Yellow, not Pink.

Pink briefly references doctrine only to point back to Yellow.

IV.B White / Blue / Red / Brown ↔︎ Pink — Inputs¶

Pink never invents numbers. Inputs come from:

White (Vol 07)
- All facts, leases, payments, medical records, emails, photos, etc.
- Pink C002's source map ensures every calculator input ties back to White.
Blue (Vol 05 — G21 Base Damages)
- G21 base totals (property damage, loss of use, rent, repairs, etc.).
- Pink B001 uses these as part of T.
Red (Vol 06 — Freeman Opportunity Damages)
- Freeman opportunity-loss totals.
- Pink B001 uses these as part of T.
Brown (Vol 04 — Rent Restitution)
- 27-year rent restitution base and interest methodologies.
- Pink B003 bridges Brown to Pink B001's T calculation.

IV.C Purple ↔︎ Pink — Deployment¶

Purple decides when and how to use Pink's outputs:

P-201, P-202, P-203 — choose which scenarios (O1/O2/O3) to present.
B-lanes — decide whether to use settlement pressure, trial posture, or hybrid.
Purple never changes Pink's math — it chooses which math to surface.

V. Guardrails & Discipline¶

V.A Pink Guardrail (Restated)¶

No new facts. All facts live in White (Vol 07) and must be cited by WT-tab/Bates.
No new doctrine. Legal theory and proportionality live in Yellow (Vol 02).
No narrative strategy. Settlement posture and sequencing live in Purple (Vol 08).

Pink is where you do the math and build the tools, not where you invent law or strategy.

Terminology discipline:

Use "systematic pattern misconduct" or "enterprise-level misconduct" as default descriptors.
Use "criminal enterprise" only inside quotes, case summaries, or statutory phrases (in Yellow or Purple).
In Pink: keep language technical and operational (inputs, outputs, tiers, schedules), not rhetorical.

VI. Typical Workflows Using Pink¶

VI.A Building a Punitive Scenario (4x–8x)¶

Confirm Facts & Bases
- White → confirm factual chains & evidence.
- Blue/Red/Brown → confirm base damages totals.
Confirm Doctrine
- Yellow B001 → pattern doctrine.
- Yellow B002 → Method-2, 4x–8x operative band.
Select Tiers
- Pink B002 → choose operative tiers (O1 4x, O2 6x, O3 8x).
Compute & Store
- Pink B001 → run E = T × M for selected tiers.
- Pink D001 → store outputs as schedules with provenance.
Prepare Experts & Evidence
- Pink C001 → generate expert declaration templates.
- Pink C002 → generate [Materials Reviewed] tables and evidence checklists.
Hand Off to Purple
- Purple P-series → decide which schedules to show and how to frame them.

VI.B Running High-Ratio Sensitivity (10x–20x)¶

Use same T as above (from Blue/Red/Brown).
Pink B002 → choose E-series tiers (E1 10x, E2 15x, E3 20x) as internal only.
Pink B001 → compute E for those M values.
Pink D001 → store as clearly labeled "High-Ratio Sensitivity / Non-Operative" tables.
Purple may reference these only in internal memos and/or appendices, never as the primary demand band.

VI.C Preparing Expert Declarations¶

Identify needed experts (e.g., punitive-damages methodology, environmental, economics).
Use Pink C001 templates to build declarations that:
- Cite Yellow B001/B002/C001 for doctrine.
- Reference Pink B001/B002 for methodology.
- Pull [Materials Reviewed] from Pink C002's source map.
Store final draft declarations with explicit materials reviewed lists and statistical/ratio assumptions.

VII. Attorney-Facing Summary¶

Plain-English Summary for Counsel

Pink Vol 03 is the execution layer of the system. It does not argue the case or decide strategy; it makes sure that whenever we say "4x–8x over total case value," we can show exactly how we got there in a clean, reproducible way.

Pink Tab B001 implements Yellow's Method-2 framework numerically (4x–8x operative, 10x–20x sensitivity only). Pink Tab B002 provides the tier vocabulary (O1/O2/O3, E1/E2/E3) so we always know which multipliers are being used and where their authority sits in Yellow C001. Pink Tab B003 plugs rent-restitution math from Brown into the broader T calculation when you want to treat 27-year rent as part of total base damages. Pink Tabs C001 and C002 ensure experts and evidence are wired correctly. Pink Tab D001 is where all the schedules and sensitivity runs live, clearly labeled as operative or appendix-only.

If a number appears in Purple or in a draft brief, there should be a straight line back to: White facts → Blue/Red/Brown bases → Yellow doctrine → Pink methodology. This tab (A000) is your map to that process.
