POSTURE NOTE — Punitive Damages Dual-Track Execution

Pink implements the calculation and execution tools for the binder system — the "HOW" that operationalizes Yellow's doctrine. This document does not establish legal theory (Yellow), compile facts (White), calculate base damages (Blue/Red/Brown), or develop negotiation strategy (Purple). Court-facing drafts present enterprise multipliers conservatively (4x-8x) in main text, reserving higher-ratio analyses (10x-20x) to Appendix/Authority materials for settlement pressure only. For pattern doctrine see Yellow B001; for multiplier framework see Yellow B002; for base damages see Blue/Red/Brown; for strategy see Purple.


I. Purpose & Scope

I.A Document Role

Pink Tab B001 is the execution playbook for punitive damages multipliers. It does not invent new law or new facts; it translates:

  • Yellow pattern doctrine (Yellow Tab B001 — 27-Year Pattern Doctrine), and
  • Yellow Method-2 enterprise framework (Yellow Tab B002 — Method-2 Enterprise Multipliers, 4x-8x band),

into a dual-track calculation workflow that can be implemented in spreadsheets, REPLs, and presentation decks.

I.B Purpose

This document answers:

"Given the base damages from Blue/Red/Brown and the legal framework from Yellow, how do we actually compute and present punitive multipliers in a disciplined, court-credible way?"

It provides:

  1. A Primary Track that is fully aligned with Yellow Method-2 and maintains a 4x-8x operative band.
  2. An Escalation Track that models 10x-20x internally, clearly segregated from court-facing work.
  3. A step-by-step workflow for integrating Pink calculators with Yellow doctrine and Blue/Red/Brown bases.

I.C What This Document Does Not Do

  • It does not argue the merits of punitive damages (that's Purple).
  • It does not contain independent factual narratives (that's White + Brown).
  • It does not replace Yellow doctrine or case law (that's Yellow Tabs B001/B002/C001).
  • It does not house final schedules (those live in Pink Tab D001 — Appendix and underlying Blue/Red/Brown tabs).

Pink B001 never "fixes" or edits these numbers; it reads them.

II.C Purple (Strategy)

Purple B-lanes and P-series documents will: - Cite Yellow B001/B002 for legal foundation. - Pull base numbers from Blue/Red/Brown. - Use Pink Tab B001 methodology (and downstream Pink calculators) to present "4x-8x" in a disciplined way.

Pink is the calculator and workflow, not the strategist.


III. Dual-Track Framework — Overview

III.A Primary Track — Method-2 Aligned (4x-8x Operative Band)

Purpose: Court-facing and mediation-facing punitive damages schedules grounded in: - Legally cognizable pattern (Yellow B001), - Method-2 allocation (Yellow B002), and - Proportional 4x-8x band.

Core steps: 1. Pull base totals from Blue/Red/Brown. 2. Confirm pattern qualification using Yellow B001 (27-year pattern doctrine). 3. Select an operative band within 4x-8x (e.g., 4x conservative, 6x moderate, 8x aggressive). 4. Compute schedules for 4x, 6x, 8x using Pink tools. 5. Export to Appendix (D001) and Purple for deployment, keeping text aligned to 4x-8x only.

III.B Escalation Track — High-Ratio Sensitivity (10x-20x, Internal Only)

Purpose: Internal modeling of high-ratio scenarios for: - Risk assessment, - Settlement negotiation planning, - Appellate risk discussion.

Rules: - Lives in Pink Tab D001 (Appendix & Schedules) and internal calculators. - Never presented as the starting position in a court-facing document. - If referenced externally at all, must be clearly labeled "sensitivity / alternative scenario, not operative request."


IV. Primary Track — Method-2 Aligned Calculation Workflow (4x-8x)

IV.A Inputs

Define the core inputs using Yellow B002's symbolic notation:

Implementation Note: - Pink B003 ("G21 Rent Restitution — Base Damages Reference") acts as a bridge for G21/Restitution input organization. - All actual numbers must be linked back to Blue, Red, and Brown tabs with WT-series evidence pins.

IV.B Scenario Bands (4x / 6x / 8x)

For a given T (Total base), Pink Tab B001 defines three canonical scenarios using Yellow B002's M (multiplier) and E (enhancement) notation:

Conservative illustration:

T = 4,268,512 + 25,000,000 + 0 = $29,268,512

  • E_4x = 29,268,512 × 4 = $117,074,048
  • E_6x = 29,268,512 × 6 = $175,611,072
  • E_8x = 29,268,512 × 8 = $234,148,096

(Moderate/Enhanced scenarios scale linearly by substituting the selected G21_base and re-computing T.)

IV.C Step-by-Step Workflow

Step 1: Gather Inputs

Confirm final base totals from: - Blue Tab 000/001/002 and the relevant 100-series tabs - Red Tab 000/001/002 and the relevant 100-series tabs - Brown's ledger and interest calculations (if included)

Step 2: Confirm Pattern Doctrine

Review Yellow B001 (27-Year Pattern Doctrine) to confirm that pattern-based enterprise treatment is legally supportable. Document which pattern elements are satisfied.

Step 3: Confirm Method-2 Applicability

Review Yellow B002 (Method-2 Enterprise Multipliers) to confirm that Method-2 is the selected framework and that 4x-8x is the operative band.

Step 4: Select Operative Tier(s)

Using Pink B002 (Multiplier Tier Scenario Matrix), select: - O1 (4x) — Conservative / floor - O2 (6x) — Moderate / midpoint - O3 (8x) — Aggressive / ceiling

Step 5: Compute Enhancement

For each selected tier:

E = T × M

Where: - T = total base from Step 1 - M = multiplier from Step 4 (4, 6, or 8) - E = enterprise enhancement

Step 6: Document & Archive

Store each computed scenario in Pink D001 (Appendix) with: - Tier ID (O1/O2/O3) - T value and source references - M value - E result - Date computed and version

Step 7: Hand Off to Purple

Purple P-series documents decide which schedules to surface in: - Settlement negotiations - Mediation statements - Trial briefs


V. Escalation Track — High-Ratio Sensitivity (10x-20x)

V.A Purpose

The Escalation Track models high-ratio scenarios strictly for internal use: - Risk assessment: "What if a jury awarded at the higher end?" - Settlement planning: "What exposure does defendant face if pattern is proven?" - Appellate discussion: "What ratios have been sustained in comparable cases?"

Again, these are illustrative only. Actual numbers depend entirely on current Blue/Red/Brown inputs.

V.C Usage Rules

1. Internal Planning Only - Use for negotiating strategy sessions, risk memos, and "what-if" modeling - Never present as the first or primary position to any court

2. Appendix Labeling - If included in any external document, label clearly as: - "High-ratio sensitivity analysis (10x-20x), appended for completeness only; not the requested punitive band." - Cross-reference Yellow Tab C001 (Legal Precedents Compendium) as the location where any high-ratio case law is preserved

3. Purple Coordination - Purple may allude to "higher exposure scenarios" but should: - Keep numeric detail in Appendix, and - Anchor public posture in the 4x-8x band


VI. Integration with Other Pink Tabs

VI.A Pink Tab B002 — Multiplier Tier Scenario Matrix

  • Translates Yellow C001's precedents into tiered authority lists
  • Supports both:
    • Primary Track's 4x-8x scenarios (core tiers), and
    • Escalation Track's 10x-20x research (appendix tiers)

Pink B001 should point to B002 when referencing specific case law support for ratio tiers.

VI.B Pink Tab B003 — G21 Rent Restitution — Base Damages Reference

  • Houses the detailed ledger and inputs for G21 restitution streams
  • Serves as a bridge between:
    • Blue's G21 schedules,
    • Brown's rent restitution logic, and
    • Pink's execution calculators

Pink B001's input section should always push users back to B003 for source-of-truth inputs before running any multiplier scenario.

VI.C Pink Tab C001 — Expert Witness Declaration Templates

  • Provides declaration templates for experts who will explain:
    • Why a 4x-8x band is appropriate under the circumstances
    • How the pattern and proportionality analysis supports the chosen scenarios

Pink B001 defines what numbers to plug into expert declarations; C001 shapes the form of those declarations.

VI.D Pink Tab C002 — Execution Evidence Protocols & Source Map

  • Ensures every input and output from B001 is traceable back to White/Blue/Red/Brown
  • Provides chain-of-custody documentation for calculator inputs

VI.E Pink Tab D001 — Appendix — High-Ratio Analyses & Provenance

  • Contains final scheduled outputs (4x-8x scenarios)
  • Houses any 10x-20x high-ratio sensitivity tables
  • Stores provenance notes and version history for the calculators

B001 is the method; C002/D001 are the chain of custody and storage for results.


VII. Attorney-Facing Summary

Pink Tab B001 is the "how-to" engine for punitive multipliers. It takes base damages that already exist in Blue/Red/Brown and applies the Method-2 enterprise framework from Yellow B002 to generate 4x-8x punitive schedules in a disciplined, court-credible way. High-ratio scenarios (10x-20x) are modeled only in internal appendices and sensitivity runs, never as the operative ask. When you see a "4x-8x" number in Purple or in a draft brief, the methodology behind it should trace back here, with all inputs grounded in White evidence and Blue/Red/Brown calculations.
