POSTURE NOTE — Multiplier Tier Scenario Matrix

Pink implements the calculation and execution tools for the binder system — the "HOW" that operationalizes Yellow's doctrine. This document does not establish legal theory (Yellow), compile facts (White), calculate base damages (Blue/Red/Brown), or develop negotiation strategy (Purple). Court-facing drafts present enterprise multipliers conservatively (4x-8x) in main text, reserving higher-ratio analyses (10x-20x) to Appendix/Authority materials for settlement pressure only. For pattern doctrine see Yellow B001; for multiplier framework see Yellow B002; for base damages see Blue/Red/Brown; for strategy see Purple.


I. Purpose & Scope

I.A Role of B002

Pink Tab B002 is a thin execution matrix that links:

  • The Method-2 multiplier band (4x–8x) from Yellow B002, and
  • The high-ratio research band (10x–20x) preserved in Yellow C001,

to Pink's calculators and schedules in a way that is:

  • Consistent,
  • Reproducible, and
  • Easy for attorneys to scan.

It does not re-argue doctrine or present case law; that is Yellow C001's job. B002 simply answers:

"For a given posture (conservative / moderate / aggressive / escalation), which multiplier tier (M) should Pink B001 use, and where would counsel find supporting authority in Yellow?"

I.B Scope

B002:

  • Defines operative tiers within the 4x–8x band.
  • Defines escalation tiers in the 10x–20x area as research-only.
  • Tags each tier with:
    • Risk level (Low / Moderate / High),
    • Typical use (e.g., mediation, trial posture, internal modeling),
    • Yellow C001 anchor sections (so counsel know where to look).

B002 is the configuration layer between Yellow doctrine and Pink calculators.

I.C What B002 Does Not Do

  • Does not contain case descriptions or quotations (see Yellow C001).
  • Does not calculate dollar amounts (see Pink B001 and D001, plus Blue/Red/Brown).
  • Does not perform legal analysis or advocacy (Yellow + Purple).
  • Does not house any schedules (those live in Pink D001 Appendix).

II.C Relationship to Purple

Purple P-203 and the B-lanes:

  • Choose which tiers to surface as part of a posture (e.g., O1/O2/O3).
  • May describe high-ratio tiers only in Appendix/Authority sections, and only as "sensitivity" not as the operative ask.

B002 gives Purple a stable tier vocabulary (O1, O2, O3, E1, E2, E3) that is already wired into Pink calculators.


III. Tier Architecture — Overview

III.A Operative Tiers (4x–8x band)

Operative tiers align with Yellow B002's 4x–8x band and are the only tiers that should appear in main text of court-facing materials.

III.B Escalation Tiers (10x–20x band, Research Only)

Escalation tiers are not operative; they are for internal sensitivity and settlement pressure analysis. If ever surfaced externally, they must be clearly labeled as "alternative / sensitivity scenarios, not the requested band."

IV. Using the Matrix — Workflow

IV.A Symbols (carried over from Pink B001)

B002 follows the same notation as Pink B001:

B002 does not compute T or E; it only provides allowed values of M under each Tier ID.

IV.B Step-by-Step Use (For Analysts / Counsel)

  1. Confirm Base Case (T).
    • Pull G21_base from Blue.
    • Pull Freeman_base from Red.
    • Pull RentRestitution_base from Brown (if elected).
    • Compute T in Pink B001, not here.
  2. Confirm Doctrinal Preconditions.
    • Confirm Yellow B001 has been reviewed and is being used as the pattern doctrine foundation.
    • Confirm Yellow B002 is the governing Method-2 framework: 4x–8x as operative band.
  3. Choose Operative Tier(s).
    • For early or risk-averse posture → O1 (4x).
    • For central trial posture with strong pattern facts → O2 (6x).
    • For most severe pattern scenario, still single-digit → O3 (8x).
  4. (Optional) Choose Escalation Tiers for Internal Modeling.
    • For risk memos / settlement planning, choose one or more of E1/E2/E3.
    • Flag clearly as "Escalation tier – internal only."
  5. Send Tier IDs and M Values into Pink B001 Calculators.
    • B001 expects (T, M); you pass M from B002's table.
    • B001 will generate the corresponding E values and schedules.
  6. Archive Outputs in Pink D001.
    • For each scenario, D001 should record:
      • Tier ID (O1/O2/O3/E1/E2/E3)
      • T and M values
      • E results (E = T × M)
      • References to Blue/Red/Brown and Yellow C001.
  7. Use in Purple Carefully.
    • Purple can show O1/O2/O3 scenarios in main text.
    • Any E-series scenarios are kept to Appendices or internal memos.

V. Matrix Detail — Tier Cards

This section gives a "card" for each tier so users can see details at a glance.

V.A Operative Tier Cards (O-series)

Tier O1 — Conservative (4x)

  • M: 4
  • Band: 4x–8x (operative)
  • Risk Level: Low
  • Use Cases:
    • Floor scenario for early mediation or risk-averse posture.
    • Appellate-safe baseline; aligns with BMW/State Farm single-digit guidance.
  • Authority Pointer:
    • Yellow C001 subsections on low-end single-digit ratios and minimal reprehensibility.
  • Notes:
    • Always included in any court-facing schedule as the conservative bound.

Tier O2 — Moderate (6x)

  • M: 6
  • Band: 4x–8x (operative)
  • Risk Level: Moderate
  • Use Cases:
    • Central trial posture for pattern-based enterprise claims.
    • Suitable when pattern is well-documented and multi-victim impact is shown.
  • Authority Pointer:
    • Yellow C001 subsections on mid-range ratios justified by pattern, duration, or institutional conduct.
  • Notes:
    • Default recommendation for strong pattern facts; still within single-digit comfort zone.

Tier O3 — Aggressive (8x)

  • M: 8
  • Band: 4x–8x (operative)
  • Risk Level: Moderate–High
  • Use Cases:
    • Upper ceiling of operative band for most severe pattern misconduct.
    • Appropriate when facts support high reprehensibility and significant harm.
  • Authority Pointer:
    • Yellow C001 subsections on upper single-digit ratios in pattern/enterprise cases.
  • Notes:
    • Represents ceiling of court-facing requests; anything higher moves to Escalation Track.

V.B Escalation Tier Cards (E-series)

Tier E1 — High (10x)

  • Status: Appendix-only / internal
  • Use Cases:
    • Internal risk assessment: "What if court accepted borderline double-digit ratio?"
    • Settlement planning to illustrate defendant's potential exposure.
  • Authority Pointer:
    • Yellow C001 subsections discussing borderline double-digit ratios and high-reprehensibility cases.
  • Notes:
    • If referenced externally at all, must be labeled as alternative/sensitivity scenario, not the requested band.

Tier E2 — Very High (15x)

  • M: 15
  • Band: 10x–20x (research only)
  • Status: Appendix-only / internal
  • Use Cases:
    • Deep sensitivity analysis; exploring "near-maximal" punitive exposure under exceptional facts.
    • Internal "what-if" modeling when evaluating defendant ability to pay vs. deterrence objectives.
  • Authority Pointer:
    • Yellow C001 commentary on very high ratios and outlier cases, where courts discuss extreme reprehensibility or repeated misconduct.
  • Notes:
    • Too aggressive for ordinary court-facing posture; preserve only in D001 and internal memos.

Tier E3 — Maximum (20x)

  • Status: Appendix-only / internal
  • Use Cases:
    • Theoretical ceiling scenario: "What if a tribunal treated this as the most extreme class of systematic misconduct?"
    • Extreme negotiation leverage modeling; never the first numeric position.
  • Authority Pointer:
    • Yellow C001 discussions of theoretical ceilings and commentary on maximum ratios; any analogical support is likely thin and fact-specific.
  • Notes:
    • Should practically never appear as a demanded number in a filing; primarily a planning and sanity-check tool.

VI. Attorney-Facing Summary

Plain-English Summary:

Pink Tab B002 gives you a menu of ratio tiers that are already aligned with Yellow's Method-2 doctrine. For everyday court-facing work, you choose among O1 (4x), O2 (6x), and O3 (8x) — all inside the conservative, single-digit band that Yellow B002 treats as operative. If you need to see "what happens" at higher ratios for settlement planning, you can look at E1/E2/E3 (10x–20x), but those remain internal/appendix-only and derive their legal context from Yellow C001.

When you see a multiplier (M) in a Pink schedule or Purple strategy memo, it should trace back to one of these tier IDs, with authority living in Yellow and numbers living in Blue/Red/Brown plus Pink B001.
