POSTURE NOTE — Execution Evidence Protocols

Pink implements the calculation and execution tools for the binder system — the "HOW" that operationalizes Yellow's doctrine. This document does not establish legal theory (Yellow), compile facts (White), calculate base damages (Blue/Red/Brown), or develop negotiation strategy (Purple). Court-facing drafts present enterprise multipliers conservatively (4x-8x) in main text, reserving higher-ratio analyses (10x-20x) to Appendix/Authority materials for settlement pressure only. For pattern doctrine see Yellow B001; for multiplier framework see Yellow B002; for base damages see Blue/Red/Brown; for strategy see Purple.


I. Purpose & Scope

I.A Role of C002

Pink Tab C002 is the evidence operations manual for Pink Volume 03. It exists to make sure that:

  • Every calculator run in Pink B001/B003 is fully traceable to White/Blue/Red/Brown.
  • Every expert declaration in Pink C001 has a clean, standardized [Materials Reviewed] table.
  • Every schedule archived in Pink D001 can be reconstructed from the underlying record without guesswork.

C002 answers:

"What must be in the file, and how do we prove it, before we run numbers or sign an expert declaration?"

I.B What C002 Provides

  • A canonical "Materials Reviewed" table template for expert declarations (C001).
  • A pre-run evidence checklist for Pink B001 (punitive multipliers) and B003 (rent restitution).
  • Category-by-category protocols for linking:
    • White WT-tabs (facts),
    • Blue/Red/Brown schedules (base numbers), and
    • Yellow doctrine (B001/B002/C001) into Pink's calculators and expert tooling.
  • Custodian & regulatory routing hooks so discovery tasks can be coordinated with WT-003 and corporate profiles (WT-301/302/303).

I.C What C002 Does Not Do

Pink C002:

  • Does not collect evidence itself (that's White, Brown, WT-003, and corporate profiles).
  • Does not opine on law, pattern, or ratios (that's Yellow).
  • Does not design strategy or leverage posture (that's Purple).
  • Does not calculate damages (that's Blue/Red/Brown + Pink B001/B003).

It is a map and protocol, not a calculator or a brief.

II.B Cross-Volume Responsibilities

  • White (Vol 07) — owns facts and evidence pinpoints (WT-series).
  • Blue/Red/Brown — own base damages math (G21, Freeman, rent restitution).
  • Yellow (Vol 02) — owns doctrine (pattern + Method-2 + proportionality).
  • Pink B001/B002/B003 — own how multipliers and restitution are calculated/applied.
  • Pink C001 — owns expert language and structure.
  • Pink C002 (this tab) — ensures all of that is properly sourced and documented.
  • Pink D001 — archives the outputs (schedules, sensitivity runs) with provenance.

III. Evidence Categories & Protocols

To keep the system predictable, Pink C002 organizes evidence into five execution categories:

  1. Base Damages Evidence — G21, Freeman, rent restitution.
  2. Pattern / Enterprise Evidence — Chains B/C/G, F1, corporate patterns.
  3. Corporate & Regulatory Evidence — licenses, registrations, complaints.
  4. Expert Work Product & Technical Materials — reports, models, lab data.
  5. Calculator & Schedule Provenance — Pink artifacts themselves.

For each category, C002 defines:

  • What it is,
  • Where it lives,
  • Why it matters for Pink, and
  • Minimal documentation standards.

III.A Category 1 — Base Damages Evidence (G21 / Freeman / Rent Restitution)

Purpose: Provide the T (Total base case value) inputs for Pink B001/B003.

Protocol:

  1. No "hand-entered" base numbers in Pink. All base figures must come from Blue/Red/Brown and be referenced by tab (and if possible row or schedule ID).
  2. Pre-Run Checklist (Base Inputs):
    • [ ] G21 totals confirmed from latest Blue workbook (tab ID + date).
    • [ ] Freeman totals confirmed from latest Red workbook (tab ID + date).
    • [ ] Rent restitution totals confirmed from Brown ledger (and reflected in Pink B003).
    • [ ] Any revisions (errata, corrected schedules) noted in Pink D001 provenance.
  3. Materials Reviewed Entries (Experts): For any expert opining on total damages or proportionality, Category 1 items must appear in their Materials Reviewed table (Section IV).

III.B Category 2 — Pattern / Enterprise Evidence

Purpose: Provide the factual backbone that justifies pattern and enterprise-level treatment (Yellow B001), but Pink only touches this at the level of "we have pattern, see Yellow/White".

Key sources include:

  • White Chains B, C, G (pre-insurance inspection, insurance coverage, environmental certification)
  • F1 alternative housing chain (WT-105, WT-209/210/211)
  • Corporate profiles WT-301/302/303 and their discovery/tracking YAML.

Protocol:

  • Pink does not summarize facts here; it simply references which chains are considered "pattern inputs" when building an expert's frame or deciding whether T should be treated under Method-2.
  • Experts who discuss pattern duration or multi-victim impact must have relevant chain tabs listed in Materials Reviewed:
    • Example: "WT-104, WT-102/103, WT-108/109/110" for Chain B/C/G; "WT-105, WT-209, WT-210, WT-211" for F1 pattern.

Minimum Standard:

  • [ ] For any pattern-linked expert opinion, at least one Chain B tab, one Chain C tab, and one Chain G/F1 tab must be present in Materials Reviewed (unless the opinion is narrowly confined).
  • [ ] No Pink document characterizes conduct as "fraud" or "criminal" — that is Purple + counsel.

III.C Category 3 — Corporate & Regulatory Evidence

This category implements the tenant-non-possession principle, custodian mapping, and regulatory routing from Purple Strategic Learnings, but at Pink's level it is only about listing and validating inputs.

Examples:

  • Corporate files for Total Restoration (WT-301), Power Adjustment (WT-302), ALC Environmental (WT-303).
  • Regulatory verifications (NYDFS adjuster licenses, NY DOS entity status, NYSDOL/board licensing, BBB complaint history, agency FOIL responses).

Protocol:

  • Pink C002 does not define how to obtain these — WT-003 and corporate profiles do that.
  • Pink simply ensures that, before an expert or calculator relies on a corporate-credibility or standards argument, there is at least one "native" corporate/regulatory item in Materials Reviewed, not just public directories.

III.D Category 4 — Expert Work Product & Technical Materials

This category tracks materials created by or for experts (not by counsel or plaintiff) that are used in Pink's process.

Examples:

  • Environmental inspection reports (Olmsted, ALC).
  • Technical cost estimates or appraisals.
  • Statistical analyses or economic models.

Protocol:

  • List each expert report or technical document in Materials Reviewed with:
    • Author / firm;
    • Date;
    • Brief description of content.
  • Ensure any numeric inputs from these reports are traceable to Blue/Red/Brown tabs if they feed into T.

III.E Category 5 — Calculator & Schedule Provenance (Pink Artifacts)

This category tracks Pink's own outputs — the schedules, runs, and calculator versions that produce E values.

Protocol:

  • Every schedule archived in Pink D001 must have a provenance card that records:
    • Date of run;
    • Tier ID (O1/O2/O3/E1/E2/E3);
    • T value used (and source references);
    • M value used;
    • E result;
    • Calculator version (if applicable);
    • Any notes or assumptions.

Every expert declaration (C001) should include a Materials Reviewed table using this structure:

  • Populate this table for each expert before finalizing their declaration.
  • Store a copy in Pink C002 or D001 as an audit trail.
  • Update as new materials are added or schedules are revised.

VI.A Pre-Run Checklist for Pink B001 (Punitive Multipliers)

Before running any multiplier scenario in B001:

Inputs:

  • [ ] Freeman base damages (Freeman_base) confirmed from latest Red schedule.
  • [ ] Rent restitution (RentRestitution_base) confirmed from Brown ledger + Pink B003 (if included).

Doctrine:

  • [ ] Yellow B001 (pattern doctrine) reviewed by counsel; pattern posture clear.
  • [ ] Yellow B002 (Method-2) confirmed as operative doctrinal framework; maximum court-facing band is 4x-8x.
  • [ ] Any high-ratio discussion will be tied to Yellow C001 and kept in Appendix/Authority only.

Evidence / Traceability:

  • [ ] For each base component, there is a WT-tab chain of evidence in White.
  • [ ] Any corporate/regulatory facts used in multiplier justification are backed by native or agency records, not just public directories.

Outputs:

VI.B Pre-Run Checklist for Pink B003 (Rent Restitution Reference)

Before relying on B003's summary figures in B001 or expert declarations:

  • [ ] Full 27-year ledger in Brown is complete and reconciled against:
    • Lease records, bank records, Loft Board/OATH records as applicable.
  • [ ] Interest calculations (CPLR 5001-5004) have been confirmed by:
    • Brown ledger logic + optional expert review.
  • [ ] Any pattern-based enhancement arguments are housed in:
    • Yellow B001/B002/C001 and Brown — not in B003 itself.
  • [ ] B003's ranges (e.g., $268K–$394K) match latest Brown ledger output.

VII. Attorney-Facing Summary

Plain-English Summary (Pink C002):

Pink Tab C002 is the evidence traffic controller for Pink Volume 03. It doesn't argue law, calculate damages, or write strategy. Instead, it makes sure that every number in Pink's calculators and every opinion in Pink's expert templates is backed by a clean, documented trail from White (facts), Blue/Red/Brown (math), and Yellow (doctrine).

For experts, C002 provides a standardized Materials Reviewed table that lists base damages schedules, pattern evidence (Chains B/C/G, F1), corporate/regulatory records, and Pink schedules in a structured way. For calculators and schedules, it defines provenance cards that show exactly how each 4x-8x (and any 10x-20x sensitivity) scenario was built. If something isn't in the table or provenance card, it doesn't belong in an expert opinion or a Pink schedule.
