GUARDRAIL: BLUE — G21 BASE DAMAGES

G21 flood-related base damages only. No enterprise multipliers, no Freeman Street.

1) What this section is

Blue (Vol 05) documents receipt-based direct damages caused by the G21 landlord flood. These are base damages proven with documents (receipts, invoices, estimates, bank statements, EOBs). All totals are calculated using 9% simple interest per CPLR 5001–5004.

Strict separation: Blue contains no Freeman Street (opportunity-loss) content. Red (Vol 06) covers opportunity-loss damages separately.


2) Blue Operating Rules (Control Contract)

Tab 002 is the only place where: - Category totals roll up into economic principal - P&S valuation bands are declared (methodology, not evidence) - Interest is computed or deferred - Tiered architecture (Tier 1 / Tier 2) is applied

No other Blue tab may introduce: - Totals or subtotals (beyond evidence inventories) - Scenario ranges or valuation bands - Alternative interest anchors or calculation methods

Incompleteness is managed exposure: Categories with pending evidence (101.8 Storage, 109 Health/Medical) are tracked as TBD rows in Tab 002 with explicit status flags, not gaps.


3) How to use this section (5-step counsel flow)

  1. Read Tab 001 — Framework. Confirm category definitions and evidence standards.
  2. Open the category page you're populating (Tabs 101–109). Build/verify the evidence inventory only (no math on category pages).
  3. Record date anchors needed for interest (see Section 5 below).
  4. Go to Tab 002 — Mathematical Verification. Enter category subtotals and date anchors; Tab 002 applies 9% simple and produces single-source totals.
  5. Export the Tab 002 tables with sources for disclosure.

6) Interest & date-anchor guidance (CPLR 5001–5004 — 9% simple)

General rule: Use the earliest ascertainable date of each loss/expense. If unclear, adopt a conservative convention and state it explicitly in the category page.

  • Property Damage (Tab 101): Anchor: Invoice/receipt date or date of loss (if contemporaneously documented). If multiple items, itemize or use earliest item date with notes.

  • Business Income (Tab 102): Anchor: Last day of each month of lost income (EOM convention) unless a specific denied/terminated booking date is documented. Tie to tax return schedules and bank statements.

  • Alternative Housing (Tab 103): Anchor: Each paid rent/housing invoice date (or EOM convention for monthly receipts).

  • Administrative & Legal (Tab 104): Anchor: Date each billed expense was incurred/paid; for labor time entries, use end-of-month for grouped entries.

  • Credit Impairment (Tab 105): Anchor: Date of adverse action/fee/interest charge; for prolonged impacts, break into documented charge periods.

  • Forced Liquidation (Tab 106): Anchor: Sale date per bill of sale/statement; note below-market differential basis in evidence.

  • Transportation (Tab 107): Anchor: Date of seizure/expense or replacement purchase; itemize per invoice.

  • Pain & Suffering (Tab 108): (non-economic) Default: Interest handling per counsel instruction; duration fact (2,278 days) documented as evidence.

  • Health & Medical (Tab 109): Anchor: Each EOB/paid invoice date; batch by provider with line-item totals as needed.

Tab 002 implementation: You'll input: (a) category subtotal(s), (b) anchor date(s), (c) optional notes on any conservative convention used. Tab 002 computes 9% simple through the verification date.


7) Evidence standards (receipt-first discipline)

  • Native files whenever possible (original PDFs, statements, EOBs).
  • Filename convention: BLUE_[Tab]_[short-desc]_YYYY-MM-DD_[amount].pdf Example: BLUE_101_Appliance_Repl_2020-02-18_1299.00.pdf
  • Traceability: Each claimed dollar must tie to a document in the category inventory.
  • Gaps: Note any missing receipts and add a conservative estimate only if counsel approves; mark clearly as estimate pending receipt.
  • No duplication: If a cost appears in two categories, assign to one and flag a cross-reference note in the other.
  • Chain of custody: Keep email source files (.eml/.msg) and statements in native form for authenticity.

8) Guardrails (to keep Blue "clean")

  • No Freeman Street references (all opportunity-loss lives in Red).
  • No policy multipliers (Network Effects / COVID Timing belong to Red).
  • No local math on category pages; all calculations/interest are in Tab 002.
  • Terminology: "9% simple interest per CPLR 5001–5004."
  • Professional tone: conservative assumptions, explicit notes on any conventions.

9) Strategic context (optional reading)

Blue as foundation (the "floor"). This section captures minimum, receipt-proven damages from the G21 flood. Red (Vol 06) addresses opportunity-loss (the "ceiling"). Together they define a settlement range.

Phase status. Phase 3 (validation) substantially complete. Tab 002 contains consensus-locked figures per G21 Base Control Number Insert v1.2 (2026-01-07). Remaining items (Tab 101.8 storage, Tab 109 health/medical) are tracked as TBD with explicit status flags.
