0) Purpose & Scope (Blue discipline)

This tab documents transportation impairment resulting from the G21 flood, limited to evidence-based, out-of-pocket bases claimable as G21 Base Damages. It contains receipts, statements, photographs, and sale records concerning (i) the pickup truck's forced sale and (ii) substitute transportation necessary for daily living and remediation tasks.

Evidence-only: No in-page calculations. All math and 9% simple interest (CPLR 5001–5004) are computed in Blue Tab 002 using the anchors below.

What this proves: When a claimant loses the use of a vehicle due to a compensable wrong, New York permits recovery of (i) direct disposition loss (e.g., conservative verified value minus compelled sale proceeds) and (ii) reasonable loss-of-use costs, typically measured by the reasonable value of substitute transportation for the period reasonably necessary to repair or replace. Pre-judgment interest is 9% simple.
