Green Volume 09 — Binder Control & Section Index

GREEN GUARDRAIL — LIEN & ASSET RECOVERY FACTS ONLY

Green Volume 09 answers one question: "If judgments are obtained, what assets are realistically available to satisfy them, and in what capacity bands?"

Green does: - Map assets that could satisfy a money judgment - Provide ACRIS-sourced ownership and encumbrance data - Calculate conservative equity bands with explicit haircuts - Show where collateral is and what legal pathways exist - Index primary source documents with CRFN references - Assemble clean, sourced capacity bands for counsel review

Green does NOT do: - Decide whether to file a lien, foreclose, or negotiate (Purple) - Apply punitive ratios or multipliers (Yellow/Pink only) - Argue bank fraud or harassment exposure (Grey/Red-OATH) - Recompute damages (Brown/Blue/Red own their calculations) - Develop settlement targets or tactical recommendations (Purple)

One-line canon:

Green Vol 09 = "Lien & asset recovery facts only," not strategy, not multipliers, not damages recomputation.

PART A — PURPOSE & SCOPE

This control document: - Locks the 7-tab architecture for Green Vol 09 - Defines guardrails (what Green does and does not do) - Specifies data inputs and source authority - Maps cross-volume integration

Cross-References: - Loan universe → Grey B001 (ACRIS Spine) - Asset mapping → Grey C002 (Collateral Map) - Lien pathways → Grey D001 (Lien Map) - Strategy → Purple Vol 08 (Settlement Posture)

PART B — ROLE IN GLOBAL ARCHITECTURE

B.1 System Position

Per GLOBAL-001 v1.3 locked volume structure:

Pre-Core (Volumes 01-04): Theory & Standalone Tracks - Vol 01 — Orange: Professional Malpractice - Vol 02 — Yellow: Enterprise Doctrine (Method-2) - Vol 03 — Pink: Punitive Execution - Vol 04 — Brown: Rent Restitution

Core Block (Volumes 05-08): Damages, Evidence, Strategy - Vol 05 — Blue: G21 Base Damages - Vol 06 — Red: Freeman Opportunity Damages - Vol 07 — White: Evidence Repository - Vol 08 — Purple: Strategy & Integration

Enforcement Cluster (Volumes 09-11): Collection & Pattern Evidence - Vol 09 — Green: Lien & Asset Recovery (this volume) - Vol 10 — Red-OATH: OATH Harassment - Vol 11 — Grey: Bank Fraud Pattern Evidence

B.2 Information Flow

Green sits at the enforcement layer. The logical flow is:

  1. Damages calculated (Brown/Blue/Red)
  2. Enterprise doctrine and ratios applied (Yellow/Pink)
  3. Strategy and sequencing developed (Purple)
  4. Asset facts provided (Green Vol 09)
  5. Pattern evidence reinforces (Grey Vol 11)
  6. Administrative companion executes (Red-OATH Vol 10)

Green is the asset map that underlies enforcement strategy: it shows what exists to collect if judgments and strategies materialize.

PART D — TAB ROLES & READING ORDER

D.1 Reader Sequence

For attorneys and enforcement professionals:

A000 → B001 → B002 → C001 → D001 → E001

Control is primarily for internal binder maintenance and onboarding.

D.2 Tab Descriptions

Green Tab A000 — Lien & Asset Recovery Executive Overview - Asset landscape narrative: Block 2512 as primary, receivables as secondary, UCC as tertiary - Search methodology validation (174 ACRIS records across three name searches) - Cross-volume orientation and reader's guide - Facts only; no ranges or strategy

Green Tab B001 — Block 2512 Equity Analysis - ACRIS transaction table with Grey Vol 11 loan ID alignment - Ownership chain from IDA deed (1996) through current - Mortgage stack showing all recorded encumbrances - Equity bands by time-slice (2008, 2014, 2019, current) - Uses loan IDs: L-2003-01 through L-2024-02

Green Tab B002 — Mortgage Receivables & Secondary Assets - $976K mortgage receivable portfolio (Queens/Bronx properties) - Tier classification: performing vs. uncertain vs. speculative - UCC-filed business assets inventory - Each asset tagged with: type, source, relative liquidity - No seizure plans; facts only

Green Tab D001 — Recovery Band Calculation - Collection capacity bands derived from B001 + B002 - Conservative haircuts applied (transaction costs, delays) - Output: realistic recovery capacity range (facts-only) - Explicit pointer: "How these bands are used lives in Pink and Purple" - No multipliers, no negotiation targets

Green Tab E001 — Primary Source Documents Index - Index of 5 ACRIS primary source documents (246 total pages) - Documents: 1982 IDA Agreement, 1996 IDA Deed, 2014 $11M loan, 2014 $7.24M mortgage, 2019 $13.75M loan - CRFN references for retrieval from ACRIS public records - Evidentiary foundation for B001 and D001 analysis - Also documents archived source research (5 legacy markdown documents)

PART E — GREY VOLUME 11 ALIGNMENT

Green Vol 09 uses the same loan ID scheme established in Grey Vol 11:

Loan ID Date Lender Principal CRFN
L-2003-01 Sept 11, 2003 Flushing Savings Bank $1,162,795.82 2004000173465
L-2007-01 Oct 4, 2007 Flushing Savings Bank $2,250,000.00 2007000496556
L-2012-01 Dec 21, 2012 Flushing Savings Bank $2,250,000.00 2013000016879
L-2016-01 Apr 25, 2016 Flushing Savings Bank $3,000,000.00 2016000152440
L-2019-01 Oct 24, 2019 Customers Bank $3,250,000.00 2019000368858
L-2022-01 Oct 25, 2022 Customers Bank $3,750,000.00 2022000367696
L-2022-02 Dec 22, 2022 Customers Bank $3,750,000.00 2022000433287
L-2024-01 Feb 9, 2024 Customers Bank $4,350,000.00 2024000047379
L-2024-02 Sept 20, 2024 Customers Bank $4,100,000.00 2024000321266

This alignment ensures consistent cross-referencing: - Grey treats loans as covenant/condition pattern evidence - Green treats the same loans as collateral/equity facts - Single canonical reference set eliminates confusion

PART F — PRIMARY SOURCE DOCUMENTS (E001)

Green E001 indexes the foundational ACRIS documents that complement, and in some cases predate, the Grey loan spine:

E001 ID CRFN Document Type Date Pages Grey Relationship
E001-01 Reel 1366/1579 NYC IDA Agreement 1982-12-01 71 Predates Grey spine
E001-02 Reel 3671/2386 NYC IDA Deed 1996-02-15 3 Predates Grey spine
E001-03 2014000090621 Building Loan ($11M) 2014-02-19 76 Parallel (different loan class)
E001-04 2014000090620 Mortgage ($7.24M) 2014-02-19 13 Parallel (different loan class)
E001-05 2019000137650 Building Loan ($13.75M) 2019-04-10 83 Parallel (different loan class)

Total Pages: 246

Relationship to Grey Spine: - E001-01 and E001-02 predate the Grey loan spine (which begins L-2003-01) - E001-03, E001-04, and E001-05 are building loans/mortgages parallel to the operating line refinance cycle tracked in Grey - For complete encumbrance analysis, both Grey loan IDs and E001 documents should be considered

PART G — SOURCE RESEARCH ARCHIVE

The following legacy research documents informed Green Vol 09 development and are preserved for audit trail purposes:

Document Type Records Status
Thread 1: "AMERICAN PACKAGE" NYC DOF Property Records Raw ACRIS search 92 Archived
Thread 2: "AMERICAN PACKAGE COMPANY" NYC DOF Property Records Raw ACRIS search 82 Archived
Thread 3: "AMERICAN PACKAGE COMPANY INC." NYC DOF Property Records Raw ACRIS search 10 Archived
Primary Lien Target: Brooklyn Block 2512 Legacy analysis Archived
Secondary Lien Targets Analysis Legacy analysis Archived

Note: These source research documents are not part of the attorney-facing binder. The synthesis tabs (A000, B001, B002, D001) contain the canonical, facts-only presentation.

PART H — GUARDRAILS

Green Vol 09 guardrails apply to all tabs:

  1. Facts only — No settlement posture, negotiation language, or leverage framing
  2. No multipliers — Ratio analysis lives in Yellow/Pink
  3. No damages recomputation — Brown/Blue/Red own their calculations
  4. Bank fraud → Grey — Green does not argue fraud exposure
  5. Harassment → Red-OATH — Green does not address OATH matters except as lien stack context
  6. Capacity bands are ceilings — Not targets, not demands
  7. Source bracketing required — Conclusions paired with explicit source citations
  8. Collateral capacity OK — "Damages computation" language NOT OK

PART I — CROSS-VOLUME INTEGRATION

I.1 With Grey Vol 11 (Bank Fraud Pattern)

Grey Tab Green Relationship
Grey B001 (ACRIS Spine) Green inherits loan IDs; Grey analyzes covenants, Green analyzes equity
Grey C002 (Collateral Map) Green B001/B002 provide detailed asset facts
Grey D001 (Lien Map) Green C001 provides lien priority framework

Grey and Green share the same loan universe but serve different purposes: Grey for pattern evidence, Green for collection capacity.

I.2 With Brown/Blue/Red (Damages)

Volume Role Green Relationship
Brown Vol 04 Rent restitution damages → Green shows where to collect
Blue Vol 05 G21 base damages → Green shows collection capacity
Red Vol 06 Freeman opportunity damages → Green shows asset ceiling

Green confirms assets exist to satisfy judgments but does not recompute values or reargue liability.

I.3 With Yellow/Pink (Multipliers)

Volume Role Green Relationship
Yellow Vol 02 Enterprise doctrine Uses Grey + Green as pattern inputs
Pink Vol 03 Punitive execution References Green D001 capacity bands

Green provides capacity bands that Pink can cite. All ratio logic stays outside Green.

I.4 With Purple (Strategy)

Purple Vol 08 enforcement lanes use: - B001/B002 for capacity facts - C001 for priority constraints - D001 for realistic ceilings - E001 for primary source verification

Green feeds facts to Purple; Purple develops strategy.

I.5 With Red-OATH (Harassment)

Red-OATH Vol 10 treats Green as neutral backdrop for Block 2512 lien landscape. D001 shows how OATH liens (if issued) fit in the priority stack.
