This tab exists solely to tell a reader where Supreme Court strategy materials live, so that the OATH volume can stand alone while remaining coordinated with the broader case framework.

I. PURPOSE STATEMENT¶
I.A. Why This Tab Exists¶
Red-OATH Volume 10 is designed as a standalone OATH harassment volume. An Administrative Law Judge, Loft Board staff member, or housing-rights attorney can read this volume without accessing the Supreme Court binder.
However, the OATH case is part of a coordinated multi-forum litigation strategy. An OATH harassment finding may support enhanced arguments in parallel Supreme Court proceedings.
This tab provides the navigation map between Red-OATH and the Supreme Court strategy materials, without importing any strategy content into the OATH volume.
I.B. What This Tab Does¶
This tab:
- Identifies where Supreme Court strategy lives (Purple Vol 08)
- Lists the specific documents within Purple Vol 08 for cross-reference
- Confirms that OATH proceedings can proceed independently
- Notes coordination points between OATH and Supreme Court
This tab does NOT:
- Analyze or summarize strategy content
- Calculate damages or multipliers
- Make strategic recommendations
- Contain any dollar amounts

Cross-Reference to Red-OATH: PT-006 (F1 Alternative Housing / Freeman Causation) directly leverages the F1 tenant chain documented in B007 of this volume. The OATH-established pattern supports the Supreme Court causation argument.
III. OATH INDEPENDENCE STATEMENT¶
III.A. OATH Can Proceed Independently¶
The OATH harassment petition documented in Red-OATH Volume 10 can and should proceed independently of Supreme Court strategy considerations.
No Purple Vol 08 content is required to file or prosecute the OATH petition.
III.B. OATH Does Not Depend on Supreme Court¶
The OATH proceeding:
- Uses different legal standards (administrative vs. civil)
- Seeks different remedies (harassment finding, penalties vs. damages)
- Operates on a different timeline (administrative proceedings vs. civil litigation)
- Does not require coordination with Supreme Court discovery
III.C. Coordination Is Optional¶
While coordination may be strategically beneficial, it is not required. Counsel may choose to:
- File OATH petition while Supreme Court case is pending
- Seek OATH finding before Supreme Court trial
- Use OATH finding as evidence in Supreme Court
- Pursue OATH and Supreme Court independently
Strategic coordination decisions live in Purple Vol 08 P-203 (Integrated Settlement Posture), not in this volume.

IV.D. Grey — Bank Fraud Volume¶
Building condition evidence documented in this OATH proceeding may also be relevant to lender/regulatory contexts. The relationship between property maintenance failures and loan covenant violations is documented in Grey — Bank Fraud volume (Vol 03 micro-section). OATH findings regarding long-term safety violations provide factual foundation for lender communications.
Note: Grey — Bank Fraud contains federal statutory analysis (18 USC §1344) that is outside OATH jurisdiction. This is a pointer only.
IV.E. Coordination Points¶
If OATH and Supreme Court proceedings proceed in parallel, the following coordination points exist:
OATH Finding as Evidence:
- Harassment determination may be admissible in Supreme Court
- Factual findings may have preclusive effect
- Pattern established in OATH supports civil claims
Witness Coordination:
- Expert witnesses (e.g., Olmsted) may testify in both proceedings
- Fact witnesses may be deposed for both uses
- Testimony coordination requires counsel attention
Discovery Coordination:
- FOIL responses obtained for OATH may be usable in Supreme Court
- Depositions taken in civil case may be usable in OATH (and vice versa)
- Document production may serve both proceedings
These coordination decisions are made by counsel, not documented in this tab.
V. WHAT D002 DOES NOT CONTAIN¶
For the avoidance of doubt, this tab explicitly excludes:
- No dollar amounts — Damages calculations live in Blue, Red, Brown
- No multiplier ratios — Multiplier doctrine lives in Yellow, Pink
- No settlement strategy — Settlement approach lives in Purple P-203
- No trial strategy — Trial arguments live in Purple chain memos and lanes

VI. CURRENT STATUS — ONGOING DISPLACEMENT¶
As of the date of this document, the tenant remains displaced from Unit G21. The unit has been uninhabitable for more than six years following the 2019 flood and subsequent remediation failures.
This ongoing displacement is relevant to both OATH (harassment effect) and Supreme Court (damages accrual) proceedings, but the implications differ by forum:
- OATH: Ongoing displacement demonstrates continuing harassment effect
- Supreme Court: Ongoing displacement affects damages calculation (addressed in Blue/Brown)
This tab notes the fact without analyzing the implications, which live in their respective volumes.
