RED-OATH GUARDRAIL — OATH HARASSMENT ONLY (STANDALONE ADMINISTRATIVE TRIBUNAL)

Red-OATH Volume 10 is a standalone harassment volume for the NYC OATH proceeding. It reframes the Supreme Court fact pattern as harassment under MDL §281(5) and 29 RCNY §2-02.

Red-OATH does: - Document 27-year harassment pattern organized into four vectors - Provide OATH-specific legal frameworks and tribunal-ready narrative - Support administrative harassment findings and remedies - Enable cross-referencing with Supreme Court case for total recovery

Red-OATH does NOT do: - Damages calculations or multipliers (Blue/Red/Yellow/Pink only) - Settlement strategy or leverage tactics (Purple only) - Jury trial preparation (Supreme Court volumes only) - Original fact documentation (White only)

PART A — VOLUME ROLE & STANDALONE POSTURE

A.1 What Red-OATH Is

Red-OATH Volume 10 is the standalone harassment volume for the NYC OATH proceeding. It:

  • Reframes the entire Supreme Court fact pattern as harassment under MDL §281(5) and 29 RCNY §2-02.
  • Organizes 27 years of conduct into four harassment vectors:
  • Financial Coercion / Economic Harassment
  • Health Endangerment / Safety Harassment
  • Process Manipulation / Administrative Harassment
  • Court / Administrative Fraud / Judicial Deception
  • Documents multi-victim, building-wide pattern, not just what happened to Christian.
  • Stays strictly within OATH's administrative remit: pattern, intent, and impact on tenants.

Red-OATH is meant to be something an OATH ALJ could read cold:

"Given these facts and this legal framework, does this landlord's conduct constitute harassment under the MDL and OATH rules?"

It is not a Supreme Court trial brief and does not do multipliers or civil damages math.

A.2 Relationship to the Supreme Court Binder

Red-OATH is a parallel track to the Supreme Court case:

  • It uses the same facts (White Vol 07) and many of the same episodes, but:
  • In OATH, those facts support harassment findings and administrative remedies.
  • In Supreme Court, those facts support damages (Blue/Red/Brown) and multipliers (Yellow/Pink).

Harassment and damages division of labor:

OATH (Red-OATH Vol 10): - Names and proves systematic harassment. - Seeks administrative relief and harassment findings.

Supreme Court (Vols 02/04/05/06/08): - Converts that pattern into civil damages, especially: - Blue 108 (pain & suffering / emotional distress, harassment-powered), - Yellow/Pink enterprise multipliers (4x—8x), - Purple strategy / settlement posture.

Harassment is the organizing principle that powers Blue 108 — not a separate damages lane. Red-OATH's job is to make that pattern undeniable in an OATH forum.

C.2 Standalone Principle

Every Red-OATH tab must be individually readable by an ALJ who has never seen the Supreme Court binder:

  • Supreme Court volumes are referenced, not required to understand OATH.
  • All facts come from White (WT-tabs) and are cited as such.
  • Blue/Red/Brown/Yellow/Pink/Purple are integration references only, mainly centralized in D002.

D.1 A000 — Executive Overview

Role: Give OATH ALJ / counsel a 2—3 page narrative: this is a 27-year harassment campaign, not a one-off dispute.

Includes: - Short statement of legal framework (MDL §281(5), 29 RCNY §2-02). - One paragraph per harassment vector (financial, health, process, court).

Highlights flagship incidents, including: - COVID storage harassment (May 2020, WT-101) as the healthiest "poster child" for health endangerment harassment. - 27-year illegal rent collection (Brown base figures) as core financial coercion. - False PRV and "inaccurate" affidavits as emblematic court/admin fraud.

Role: Teach the law and sketch the story grounded in those elements.

Includes: - MDL §281(5) statutory language and OATH's harassment definition. - 29 RCNY §2-02 harassment rules (course of conduct, intent to cause vacatur/waiver/surrender). - Standard of proof, burden, and OATH's remedial tools. - Element-by-element outline of how the fact pattern maps to harassment.

D.3 B002 — Master Timeline — 27-Year Harassment Pattern

Role: Answer the ALJ's "Is this really a pattern?" question in a single document.

Includes: - Timeline table from 1998—2025, with columns for event, vector(s), impact, WT-evidence. - Phase breakdown (illegal rent era → repeated flooding → professional manipulation → post-flood coercion → COVID era → false PRV / ongoing exposure). - Clear tagging showing how the same landlords / agents recur across phases.

D.4 B003—B006 — Vector Tabs

Each vector tab: - States OATH legal hook (how that vector satisfies MDL §281(5) and 29 RCNY). - Has an incident table: Incident → Date → Evidence (WT-x) → Harassment element → Witnesses. - Explains how that vector shows intent to drive tenant out or force surrender of rights.

B003 — Financial Coercion / Economic Harassment - Illegal rent (27-year stream; Brown base), diverted insurance, storage ultimatum ("if you do not empty them, we will"), buyout / economic pressure tactics.

B004 — Health Endangerment / Safety Harassment - Chronic flooding, mold, false alternative housing (F1), COVID storage threats as flagship, inadequate remediation despite PRV.

B005 — Process Manipulation / Administrative Harassment - PAA autonomy promises, Loft Board scheduling / cancellation, professional abandonment, access-letter/junk "paper harassment".

Role: Prove this is not just about Christian.

D.6 C001 — Evidence Inventory & Witness Requirements

Role: Make sure every incident in B003—B007 is backed by at least one WT-tab / exhibit.

Includes: - Evidence checklist by vector and by flagship incident (COVID, F1, PRV, etc.). - COVID block front-and-center: WT-101, PDFs, EO 202.8 reference. - Witness matrix: who supports which vector; what you still need (affidavits, declarations).

D.7 C002 — Implementation Roadmap & Task Tracking

Role: Turn "we should do an OATH case" into a step-by-step plan.

Includes: - Task table: verify OATH docket status, draft petition, serve, FOIL requests, witness prep. - Status fields (Not started / In progress / Done). - "Last verified status" for the live OATH case, explicitly marked TBD until counsel confirms.

D.8 D001 — OATH Procedural Appendix

Role: Give a lightweight practice guide for this specific OATH harassment case.

Includes: - Template petition outline / headings (facts → harassment theory → relief). - Short guide to OATH procedures: jurisdiction, filings, hearings, orders. - Space to log hearing dates, outcomes, ALJ orders.

D.9 D002 — Supreme Court Integration — Pointer Only

Role: Explain how OATH findings feed the Supreme Court case without doing strategy or math.

Includes: - Integration table: OATH element → which Supreme Court volume uses it → for what (e.g., Blue 108 narrative support, Yellow/Pink multiplier posture, Purple lanes). - Very explicit statement that: - Harassment money lives inside Blue 108 (pain & suffering / emotional distress), not here. - Multipliers and ratios live in Yellow/Pink, not here. - Strategy lives in Purple, not here.


PART E — HARASSMENT PATTERN & VECTOR CANON

E.1 Harassment as the Organizing Principle

Across all volumes, we lock the following canon:

Red-OATH's thesis: This landlord's entire course of conduct — financial, physical, administrative, and judicial — constitutes harassment under MDL §281(5) and 29 RCNY §2-02.

OATH's role is to: - Name the pattern, - Prove the elements, - Obtain an administrative finding.

Supreme Court's role is to: - Convert that pattern into damages and multipliers, using: - Blue 108 as the main harassment-driven emotional distress lane, - Yellow/Pink for enterprise multipliers, - Purple for posture and deployment.

E.2 The Four Vectors (Canonical)

We treat these as the four canonical harassment vectors:

  1. Financial Coercion / Economic Harassment (B003) Illegal rent, diverted insurance, coercive storage threats, buyout pressure.

  2. Health Endangerment / Safety Harassment (B004) Repeated flooding, mold, false alternative housing (F1), COVID storage harassment, PRV-driven "fake safety".

  3. Process Manipulation / Administrative Harassment (B005) Manipulating the Loft Board, PAA promises, professional abandonment, paper churn to exhaust the tenant.

  4. Court / Administrative Fraud / Judicial Deception (B006) False affidavits, misstatements to court, PRV misrepresentations, stipulation bait-and-switch.

B007 then adds multi-victim depth across these vectors.

PART G — OATH-SPECIFIC GUARDRAILS

These guardrails are mandatory for all Red-OATH drafting:

  1. Standalone for Tribunal Every tab must be readable by an OATH ALJ without Supreme Court context.

  2. No Multipliers, No Damages Math No 4x—8x, no 10x—20x, no punitive calculation. All math stays in Blue/Red/Brown/Pink.

  3. No Supreme Court Strategy Here No settlement posture, no B-lane planning. Reference Purple only via D002 pointer.

  4. Facts from White, Not Memory All factual claims must be traceable to WT-tabs or other White docs. Red-OATH can summarize, but not invent.

  5. MDL §281(5) / 29 RCNY Only This volume's legal framework is OATH-specific harassment law. Other causes of action live in Supreme Court volumes.

  6. Doc 1 (Global MASTER case org) Excluded Red-OATH does not import the non-OATH "MASTER Case Organization Framework" doc; it has its own control.

  7. 12-Tab Architecture Locked Control + A000 + B001—B007 + C001—C002 + D001—D002. Do not add or delete tabs in this volume.
