Grey Tab B003 — Tenant Impact & Harassment Linkage¶
GUARDRAIL: GREY — BANK FRAUD
Bank fraud evidence and 18 U.S.C. § 1344 elements. Criminal referral documentation. No civil damages calculations.
POSTURE NOTE — Tenant Impact Documentation¶
This tab documents tenant-level impact of the covenant-violating conditions associated with 226 Franklin / Block 2512, and links those impacts to: loan/covenant periods (from Grey Tab B001), condition clusters (from Grey Tab B002), tenant cohorts (G21, F1 chain, other units as developed), and Red-OATH harassment vectors (V1-V4) as cross-reference tags only. It is pattern evidence, not argument: no damages math (Blue/Red/Brown/Pink), no settlement or leverage strategy (Purple), no harassment law or OATH analysis (Red-OATH Vol 10). One-line role: Show, in a tenant-by-tenant grid, how chronic condition failures mapped onto real human impact, without arguing harassment or calculating dollars.
0) Purpose & Scope¶
0.1 Position in Grey Volume 11¶
| Tab | Title | Role |
|---|---|---|
| B001 | Loan & Covenant Timeline (ACRIS Spine) | What loans, when |
| B002 | Property Conditions vs Loan Covenants | Conditions vs promises |
| B003 | Tenant Impact & Harassment Linkage | Who was affected, how |
B003 answers: "Given the loan/covenant + condition mismatch, who was affected, when, and how?"
0.2 What B003 Does¶
- Pulls tenant-level rows from White/Red evidence
- Tags each row with condition cluster(s) and OATH vector(s)
- Feeds Grey C001 (bank-fraud elements) and Yellow/Pink (enterprise pattern) as impact context
- Does NOT perform legal analysis
1) Condition Clusters & OATH Vector Tags¶
1.1 Condition Clusters (from B002)¶
| Code | Cluster | B002 Reference |
|---|---|---|
| C1 | Chronic Flooding & Water Intrusion | M (Maintenance) |
| C2 | Mold / Dampness / Air Quality | M, E (Environmental) |
| C3 | Fire Safety & Egress | C (Compliance) |
| C4 | Structural & Code Violations (Non-Fire) | C, R (Repair) |
| C5 | Loft Law / IMD / Illegal Occupancy | O (Occupancy) |
| C6 | False or Inadequate Alternative Housing | I (Insurance) |
| C7 | Storage / Property Security Issues | M |
| C8 | Administrative / Legal Process Pressure | — |
1.2 Red-OATH Vector Tags (Cross-Reference Only)¶
| Tag | Vector | Red-OATH Tab | Usage in B003 |
|---|---|---|---|
| V1 | Financial Coercion | Red-OATH B003 | Label only |
| V2 | Health Endangerment | Red-OATH B004 | Label only |
| V3 | Process Manipulation | Red-OATH B005 | Label only |
| V4 | Court/Admin Fraud | Red-OATH B006 | Label only |
Critical: These tags are used solely as cross-reference labels to show which incidents Red-OATH later treats as harassment. B003 makes no harassment legal argument.
2) G21 (Christian Gray) — Anchor Tenant Impact¶
Tenant / Unit: Christian Gray (G21)
Status: Primary plaintiff; long-term tenancy; flagship flood victim
2.1 Key Time Windows¶
| Period | Window | Key Events |

| Pre-Flood | Before Oct 2019 | Habitability baseline; Loft Law context |
| Flood & Displacement | Oct-Dec 2019 | G21 catastrophic flood; immediate displacement |
| Post-Flood / Remediation | Dec 2019-2023 | Alleged remediation; mold questions; re-flood |
| Freeman Displacement | Oct 2019-present | Living/working at Freeman Street studios |
2.2 G21 Condition Impact Matrix¶
| Cluster | Time Window | Impact Summary (Facts-Only) | Covenants | Vector Tags | Evidence |
|---|---|---|---|---|---|
| C1 (Flooding) | Oct 2019 | G21 flooded; unit uninhabitable | M, C, I | V2, V1 | WT-106, WT-111 |
| C2 (Mold) | Post-flood | Ongoing mold concerns post-"remediation" | M, C | V2 | WT-107, WT-108, WT-109, WT-110 |

Evidence Sources: WT-106 (G21 Scope), WT-107 (Olmsted Baseline), WT-108 (ALC PRV), WT-109 (Olmsted Response), WT-110 (Olmsted Follow-Up), WT-111 (July 2023 Re-Flood)
3) F1 Chain — Four-Position Pattern¶
Unit: F1, 100 Freeman Street
Role: Alternative housing offered to Christian post-flood; multi-tenant pattern demonstrating chronic condition issues and concealment
3.1 Pattern Overview¶
| Position | Tenant | Period | Outcome | Evidence |
|---|---|---|---|---|
| 1 | Christopher Kauch | Pre-2019 | Complaints → buyout/vacatur | WT-209 |
| 2 | Christian Gray | Nov 2019 | F1 offered → declined | WT-105 |
| 3 | Jason Fesel | Post-2019 | Health impacts → settlement | WT-210 |
| 4 | Nicholas Lemons | Post-Fesel | Demolition reveals concealed mold | WT-211 |
3.2 Position 1 — Christopher Kauch (Pre-Offer Pattern)¶
Tenant: Christopher Kauch (a/k/a Chris Love)
Evidence Source: WT-209
Period: Years prior to Christian's flood
Condition Clusters: - C1 (Chronic Flooding & Water Intrusion) - C2 (Mold / Dampness) - Possibly C5 (Loft/IMD) depending on record
Impact Summary (Facts-Only): - Multiple complaints over years regarding leaks and potential mold - Ultimately vacated via buyout agreement
Covenant Linkage: Maintenance / Compliance / Habitability — same core covenants in B001/B002 loan periods
Vector Tags: V2 (health), V1 (financial)
3.3 Position 2 — Christian Gray (F1 Offer & Declination)¶
Tenant: Christian Gray (G21; F1 as proposed "alternative housing")
Evidence Source: WT-105
Period: Late November 2019 (post-flood, pre-insurance declination)
Condition Clusters: - C6 (False or Inadequate Alternative Housing) - C5 (Loft/IMD) if applicable to F1
Impact Summary (Facts-Only): - Landlord offers F1 as "alternative housing" after G21 flood - Offer includes buyout amount and relocation to F1 - Christian declines, citing: - Buyout amount inadequate - Need for studio-grade workspace/proximity - Concerns about suitability of F1
Covenant Linkage: If F1 has same covenant-backed maintenance obligations, offering a problematic unit as "solution" intersects with Maintenance, Compliance, Occupancy, Habitability covenants
Vector Tags: V1 (financial), V2 (health), V3 (process)
3.4 Position 3 — Jason Fesel (Health Impacts & Settlement)¶
Tenant: Jason Fesel
Evidence Source: WT-210
Period: Post-offer / post-Christian declination
Condition Clusters: - C2 (Mold / Dampness / Air Quality) - C1 (Flooding) if documented - Possibly C3 (Fire/Code) if documented
Impact Summary (Facts-Only): - Occupies F1 after Christian declines - Experiences health impacts attributed to conditions in F1 - Retains counsel (Margaret B. Sandercock, Esq.) - Matter concludes in settlement with back-rent forgiveness
Covenant Linkage: Same bank covenants about maintenance, compliance, and lawful occupancy were in force during this period (per B001)
Vector Tags: V2 (health) primary; V1 (financial); V3 (process)
3.5 Position 4 — Nicholas Lemons (Demolition & Concealment Evidence)¶
Tenant: Nicholas Lemons
Evidence Source: WT-211
Period: After Fesel's occupancy and settlement
Condition Clusters: - C2 (Mold / Dampness / Air Quality) - C4 (Structural/Concealment)
Impact Summary (Facts-Only): - During demolition work in F1, Lemons discovers concealed mold conditions - Captures 3 photographs + 1 video documenting visible mold - EXIF metadata shows capture dates/times - Physical evidence indicates conditions persisted despite prior settlement and purported remediation
Covenant Linkage: Strong factual evidence that maintenance/compliance covenants were not actually being fulfilled, even after prior tenant complaints and settlement
Vector Tags: V2 (health); V4 (fraud) if earlier filings claimed conditions were corrected
3.6 F1 Chain Synthesis (Pattern, Not Strategy)¶
| Element | Evidence |
|---|---|
| Longitudinal failure | Same conditions across 4+ years, 4 tenants |
| Alternative housing inadequacy | Offering problematic F1 to G21 flood victim |
| Multi-tenant corroboration | Independent complaints from unrelated tenants |
| Physical evidence | EXIF-dated photos/video of concealed mold |
| Settlement pattern | Multiple tenants required legal intervention |
Strategic deployment of this pattern (arguing alternative housing non-viability or enterprise-level reprehensibility) lives in Purple and Red-OATH, not here.
4) Other Tenants & Building-Wide Pattern (Placeholders)¶
4.1 Future Tenant Rows¶
