Per our August 27 call, here are the two pages — the Kozek draft-complaint analysis and the claims table — for your lane-by-lane ruling:

The first page analyzes the never-filed May 2025 draft: parties, the factual allegations mapped paragraph by paragraph, its eight causes of action, and the binder support behind each allegation. The second page is the architecture: its Part B maps each of the eight draft causes to its evidence modules in the binder, and Part C carries the claim and remedy vehicles identified outside the draft — fifteen architected in the binder plus the additions identified after our call — each with its record, organized so you can rule each lane in or out for the new complaint.

Among the additions, one flagged for you specifically: the ALC-directed claims — Kowalewski and Glass, plus the company (fraud, aiding and abetting, negligent misrepresentation, professional negligence) — per your note that the affiants, or at least their company, could be brought into any new litigation as additional defendants. The candidate-defendant record is linked from the claims table page. One question on the entity decision, so we're aligned before drafting: I assume a firm like ALC carries professional-liability coverage, though nothing in my record confirms their policy. Does likely coverage factor into whether the company is worth naming, and does the mix of fraud versus negligence theories matter for reaching it, given that such policies often exclude intentional conduct?
