On the Verified Petition check you mentioned on the call: I have retrieved it, and it is attached — the signed Order to Show Cause (Index No. 6086, signed June 30, 2020, Judge Barany) with the annexed Verified Petition, verified June 29, 2020. On its face: 1. Paragraph 14 contains the insurance and fixture-ownership allegations. It alleges the landlord's steps "were geared to receiving a high insurance payment to landlord"; that, on information and belief, "landlord allowed its insurance carrier to believe that landlord, not petitioner, owned the walls, kitchen, bathroom and appliances in the unit"; and that, on information and belief, landlord "has been paid by its insurance carrier but has not used the funds for their intended purpose, mold remediation and repairs in petitioner's unit." Your recollection on the call was right — those facts are in the Petition. 2. Paragraph 15 states the entire relief sought: an order requiring an adequate scope of remediation, and a finding of harassment "based on the facts set forth in paragraph 14." No fraud cause of action is pleaded; the insurance allegations appear only as harassment predicates, on information and belief. 3. The Petition contains no claim for property-damage compensation, business-income losses, rent restitution or overcharge, breach of lease, negligence, or constructive-eviction damages (paragraph 6 states the constructive-eviction fact but claims nothing on it), and nothing concerning Freeman Street.

Two questions for you, whenever convenient: 1. Does the release's "claims... contained in Petition" language reach a later fraud cause built on the paragraph 14 facts, or only the claims actually asserted (remediation, harassment, penalties)? 2. On your reading, do the damages claims absent from the Petition — the items in point 3 above — sit outside the release?
